APP TERMS AND CONDITIONS

The NKT Muay Thai application, web app and related digital services (the “App”) are managed by:

These terms govern access to and use of the App and its related digital services by users (the “Users”).

These Terms supplement, but do not replace, the Association's Articles of Association and any regulations, membership conditions, waivers, privacy notices and other agreements that may apply to the relationship between the User and NKT.

Creating an Account in the App does not automatically grant membership of the Association, registration with federations or sports promotion bodies, or the right to participate in sporting activities. These relationships remain subject to their respective procedures, requirements and confirmations.

Depending on the account type, User status and features available from time to time, the App may allow Users to:

• create and manage a personal Account;
• view calendars, classes, schedules, coaches and availability;
• book and cancel classes;
• access waiting lists;
• check in or record attendance at activities;
• view attendance, training and personal statistics;
• check membership or registration status;
• enter or upload medical-certificate information;
• manage trials, waivers and related documents;
• view payment and receipt information;
• receive communications, notices and notifications;
• communicate with authorised personnel;
• view sporting statistics and fight records, where provided;
• access other features NKT may make available.

Some features may be reserved for registered Users, members, Users who meet the applicable requirements or specific categories of Users.

A personal Account is required to use features that require authentication.

The User agrees to provide truthful, accurate and current information and promptly report or correct any changes.

The Account is personal and may not be transferred or shared with others.

The User is responsible for safeguarding login credentials and must promptly notify NKT if unauthorised access, lost credentials or misuse of the Account is suspected. infonktmuaythai@gmail.com.

Creating Accounts using another person's identity or intentionally providing false information is prohibited.

Use of the App by underage athletes is subject to the authorisations and requirements imposed by applicable law and Association rules.

Where necessary, registration, membership, waiver execution, financial obligations and other declarations requiring adult involvement must be completed or authorised by a parent or person exercising parental responsibility.

NKT may require the parent or guardian to be present and verify their identity before allowing the minor to take part in certain activities.

The mere creation of an Account by a minor does not replace these authorisations.

Use of the App does not itself constitute authorisation to practise sport.

Participation in NKT activities is subject to applicable laws, sporting regulations and Association rules.

Where required, the User must hold a valid medical certificate appropriate to the type of activity practised.

NKT may prevent booking, check-in or participation if the certificate is missing, expired, invalid or otherwise non-compliant with applicable requirements.

The User is responsible for the accuracy and authenticity of documents provided. The App and its information do not provide medical advice and do not replace a doctor's opinion.

Places for each activity may be limited. Booking through the App assigns a place according to the availability shown and the operating rules applicable to that activity.

When a class is full, the User may be placed on a waiting list. Any available places are assigned according to the order and methods shown in the App.

Users must cancel promptly if unable to attend, so the place can be made available to others. NKT may distinguish between:

• cancellation within the applicable deadline;
• late cancellation;
• failure to attend (“no-show”).

For repeated late cancellations or no-shows, NKT may temporarily restrict new bookings under the rules and thresholds communicated in the App. These restrictions are organisational and ensure fair use of available places.

Check-in is personal. Checking in for other Users, tampering with attendance systems or claiming false attendance is prohibited. Technical errors or attendance disputes may be reported to NKT staff.

Calendars, schedules, coaches, availability and venues shown in the App may change for organisational, technical or sporting reasons, or due to circumstances beyond NKT's control.

NKT may cancel, replace or change a class, coach, time or venue when reasonably necessary. Where possible, material changes will be communicated through the App, notification, email or other available channels.

The App may show or record information about fees, classes, private lessons, registrations, payments and receipts. Available payment methods are those communicated by NKT from time to time.

Displaying a payment record in the App does not replace a receipt or tax-relevant document where required by applicable law. Errors relating to payments, amounts or receipts must be reported to NKT for verification.

Unless a specific feature expressly states otherwise, simply booking an activity through the App does not automatically constitute an online purchase.

NKT may use the App to send functional communications concerning bookings, schedule changes, waiting lists, certificates, Association activities, safety or Account management. These may be sent through in-app notifications, push notifications or email, depending on available settings and features.

Promotional communications are governed separately and, where required by law, are sent only with the User's specific consent.

Users may disable push notifications in their device settings, although information necessary to manage the relationship may still be communicated through other appropriate channels.

The User agrees to use the App only for lawful and personal purposes. In particular, it is prohibited to:

• attempt to access other Users' Accounts;
• circumvent authentication, booking, check-in or security systems;
• manipulate attendance, statistics, credits or waiting lists;
• use automated systems to book or interfere with the App;
• introduce viruses, malicious code or other tools intended to compromise the service;
• use the App to harass, threaten or harm other Users or NKT personnel;
• send unlawful, offensive or rights-infringing content through messaging systems;
• use App data or content for unauthorised commercial purposes.

NKT may take reasonable measures to protect Users, personnel, IT systems and proper service operation.

NKT may temporarily limit or suspend Account features where reasonably necessary, including:

• breach of these Terms;
• security reasons;
• fraudulent or abnormal Account use;
• repeated breaches of booking rules;
• loss of requirements for a specific activity;
• technical work or maintenance;
• compliance with legal obligations or competent authorities.

Where appropriate and compatible with security or urgency, NKT will inform the User of the restriction and how to request a review. Suspending App access does not automatically end any membership or registration relationship, which is governed separately.

The User may request Account deletion through available App features or by contacting NKT. Deletion does not necessarily result in immediate deletion of all personal data where further retention is required by law or otherwise lawful under the Privacy Policy.

NKT takes reasonable measures to keep the App available and working correctly, but cannot guarantee that it will always be free from interruptions, errors or temporary unavailability.

The App may be temporarily suspended or limited for maintenance, updates, technical problems, security work or causes beyond NKT's control. App malfunctions do not alter Users' mandatory statutory rights.

For a malfunction affecting a booking, payment or other relevant operation, NKT may verify available records and correct the entry manually where necessary.

The App may process statistics concerning the User's participation, training and sporting activity. Where provided, an internal leaderboard may show authenticated Users aggregated member-participation information as described in the Privacy Policy.

These statistics are informational and motivational and do not constitute official assessments of athletic ability. Errors may be reported to NKT.

Unless otherwise stated, trademarks, names, logos, graphics, texts, photographs, materials, the App structure and related content are owned by NKT or used under a lawful title.

The User receives only a personal, limited, non-exclusive and non-transferable right to use the App to access NKT services. Reproduction, distribution, commercial exploitation, modification or unauthorised use of App content is prohibited, except where permitted by law.

The User remains responsible for information provided and use of their Account.

NKT is not liable for service disruption or inability to use the App caused by circumstances not reasonably within its control, including the User's device, internet connection, third-party services, extraordinary maintenance or force majeure.

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law.

These Terms are not a waiver of the inherent risks of sporting activity. Statements, notices and waivers relating to participation in sporting activities are governed separately.

Users' personal data is processed as described in the NKT Muay Thai Privacy Policy, available in the App and on the website.

Acceptance of these Terms does not constitute consent to processing activities that require separate specific consent under applicable law.

NKT may update the App and these Terms for technical, organisational or security needs, to introduce new features or comply with legal changes. The current Terms will be made available in the App or on the website with the update date.

For material changes significantly affecting Users' rights or obligations, NKT will provide appropriate notice and, where necessary, request renewed acceptance before use of the affected services continues.

These Terms are governed by Italian law. Any dispute is subject to the jurisdiction criteria established by applicable law.

Where the User qualifies as a consumer under applicable law, the mandatory territorial jurisdiction provided for their protection remains unaffected.
